Hello, pro-democracy readers! Keep your eyes peeled: President Donald Trump appears poised to continue his anti-voting crusade in a nationally televised address Thursday. Don’t worry, we’ve got you covered with what he’s expected to say. Meanwhile, Immigration and Customs Enforcement (ICE) told a court that it may have documents relevant to a search about deployment at polling locations.

But there’s also some good news to highlight. The Department of Justice (DOJ) lost two more voter roll cases, making them 0-15.

All that and more is on the docket today. See you tomorrow!

Trump is poised to attack voting systems and undermine elections during a primetime address

  • Trump is expected to take to the airwaves Thursday and push false claims of widespread voting fraud by citing soon-to-be-declassified intelligence information purporting to show irregularities and vulnerabilities in voting machines in the 2020 presidential election.

  • The goal? By continuing to sow doubts about election systems, Trump may be looking to create a pretext to challenge potential Democratic victories in the upcoming midterms and push for his anti-voting SAVE America Act.

  • Stay tuned to Democracy Docket, as we’ll have constant coverage of his speech.

In a reversal, ICE admits it may have documents on agents at polling places

  • ICE told a court that it may have documents relevant to Democrats’ demand for the Trump administration’s possible plans to deploy agents at the polls this fall.

  • Its disclosure is a significant reversal after telling a judge earlier this year it found “no responsive records” in response to the Democratic National Committee’s Freedom of Information Act requests for documents about the “potential employment of federal agents and troops to polling places, drop boxes, and election offices.”

Two more DOJ voter roll lawsuits tossed

  • In a win for voters, the DOJ lost its 14th and 15th voter roll cases, with zero wins, when GOP-appointed federal judges dismissed the government’s lawsuits seeking access to Virginia and New Mexico’s full voter records.

  • The judge in the Virginia case was a Trump appointee, so that’s fun.

With justices testifying, Democrats demand Supreme Court ethics reform

  • Congressional Democrats used a pair of U.S. Supreme Court budget hearings to implore Justices Amy Coney Barrett and Elena Kagan to support judicial ethics reform and stand up to Trump.

  • While the hearings were ostensibly about the Supreme Court seeking a $16.6 million budget increase to bolster security, that didn’t stop lawmakers from making the case for ethics reforms at the Court.

Win for Arkansas voters as judge blocks ballot initiative restrictions

  • A federal judge struck down several Arkansas laws that made it harder for voters to pass ballot initiatives.

  • Some of the measures that were invalidated: requirements that petition signers have photo ID, a requirement for warnings for all prospective signers about petition fraud, making petition signers read proposed ballot titles out loud and making paid canvassers disclose their address before collecting signatures.

➤ More about the overturned measures

Trump just disabled a key federal election agency months before the midterms

  • In his latest video, Marc breaks down Trump's firing of the remaining commissioners at the Election Assistance Commission (EAC) and what that could mean moving forward. He also warns that without commissioners, the White House may try to pressure EAC staff directly.

Here we share noteworthy briefs on all things voting rights and democracy. Have a footnote for us? Send it to newsletters@democracydocket.com.

  • Are we seeing a preview of a potential Democratic presidential ticket for 2028?

  • The latest in the ongoing reflecting pool drama: Trump claimed it was drained to fix “scars and damage” 300 yards long. Unsurprisingly, reporters looking at the drained pool have been unable to find what the president was talking about.

  • Just when you thought the “taking over countries” stuff was over, Trump decided to bring it back. In the midst of a full-blown posting fit this morning, Trump shared an image of a map that showed the U.S. taking over Canada, Venezuela and Greenland. Turns out this is an edited version of a real photograph.

  • This made me feel ancient: It’s the 10th anniversary of Hillary Clinton’s “Pokemon Go to the polls” remarks at a campaign rally during her presidential run. Clinton’s attempt to make a joke about the then-popular game has since become a much-used meme.

  • We all know Trump loves conspiracy theories (especially about voting), but there are apparently some that he won’t indulge in: Those surrounding the death of Lindsey Graham.

  • Look, it brings me no pleasure to tell you this — it won’t add value to your day — yet I feel compelled to inform you that the White House thought it was a good use of time to celebrate “Spongebob Day”… by posting a photo of the character wearing a hat with “MAGA” written on it.

Tomorrow at 6:30 p.m. ET: Marc Elias hosts a live members-only panel with Janai Nelson, Joyce Vance and Cody Wofsy to break down the rulings shaping democracy from this past Supreme Court term. Ask questions from the people who argued the cases themselves. Upgrade today to secure your spot.
